Beating out investors for REO properties - 10/18/2012

Some home buyers look to the foreclosed property market for a bargain deal on a new home. It's not entirely surprising - the National Association of Realtors (NAR) reports distressed properties cost, on average, 20 percent less than standard homes for sale. However, those looking to buy a home to live in might find surprising competition from investors looking to purchase a bank-owned property - also called REO - that they will later sell, according to the Wall Street Journal. There are ways for home buyers to stay ahead of the competition and buy a foreclosed home before the investors do.

Hire a real estate agent with REO experience

The top strategy home buyers should keep in mind is how to pick the right real estate agent. Some have more experience than others when it comes to dealing with foreclosed properties, which could give home buyers a leg up on the deal. They can also help identify foreclosed homes that are in better condition than others, helping home buyers find properties that may not need a lot of work beforehand and that may require less maintenance over time, reports the Wall Street Journal.

Consider government-owned

Freddie Mac, Fannie Mae and the Department of Housing and Urban Development (HUD) have all adopted measures that favor owner-occupants, also known as regular home buyers, over investors when it comes to the buying and selling of bank-owned homes. According to HUD, only home buyers who are purchasing an REO to use as their primary residence can submit bids for the home in its first 10 days on the market. After that time period, investors can enter the fray. However, that week and a half advantage can make all the difference for a home buyer, reinforcing the importance of having a real estate agent who's familiar with the process and can act quickly on new REOs.

Handle finances ahead of time

According to HUD, it's advisable to secure a preapproval on a mortgage before shopping for an REO property. The Wall Street Journal also reports having financing prearranged can give home buyers the benefit of time, allowing them to process a REO sale all the more quickly. Investors often pay for REO homes with cash, leaving unprepared home buyers on the outside looking in. While these steps won't guarantee a home buyer won't be outbid for a foreclosed home, it can give them a good head start on their investor competition.

The marina will be operated by Coastal Marina Management, affiliated with Galati Yachts, and will offer wholesale fuel, launching services and wet slips for members. The club plans to partner with several reputable boat brokers for members who wish to purchase a boat.

Phase Two, slated for completion in early 2009, will include construction of the state-of-the-art marina, dry storage facility, pool and pool deck and The Bridge - a 4,200 square-foot, two-story clubhouse featuring a bar and grill, nicely-appointed restrooms and showers and The Fleet Room, available for social gatherings and meetings.

"The view from The Bridge will be spectacular because it's right on the waterfront," said Liz Empson, North Light director of sales. "Members and their families will be able to enjoy themselves in a classy, but relaxed environment. Here, luxury will be comfortable and attainable for families."

Phase Three includes the construction and grand opening of the 12,000 square-foot clubhouse and will commence once Phase Two is complete.

"Service is paramount at North Light Yacht Club," said Joe Winkeler of Ozean, LLC, owner and developer of the project. "We want to provision the boats and help families launch in the morning and then guide them back in after a full day out on the water. We'll unload, clean and retire the boat back into its slip while the family socializes and enjoys dinner together at the club. It's about letting real, everyday people indulge. And the club's location in Niceville will provide boaters with easy, convenient access to the entire Gulf Coast."

Renderings, descriptions of amenities and pricing are all available at the new Information Center. Currently, the club is offering dry-slip, social and corporate memberships. Those interested must complete and submit a signed membership application and deposit.

The club is a 15-minute boat ride to the Gulf of Mexico, a 10-30 minute drive from most Okaloosa and Walton County resorts and a 10-minute drive to Okaloosa Regional Airport

One market where both Ross and Keith see buying opportunities galore is Florida. The best Florida bargains are in condominiums. Kerry McNulty, a real estate agent in the Panhandle resort town of Destin, says Panhandle prices have fallen 25% to 30% since 2005. A two-bedroom beachfront condo that might have sold for $600,000 in 2005 can now be had for $425,000, he says.

But before booking a flight to the Sunshine State to start your bargain hunting, consider the risks. The Florida market may have further to fall. Property taxes and insurance bills are soaring. And if you're a believer in the devastating impact of global warming (I'm a tad skeptical, but that's another column), an investment in property on the Gulf or Atlantic coast probably isn't for you.

Not only is the hurricane risk higher, but the three-foot rise in sea level predicted by most experts would swamp most Florida beaches, according to real estate consultant Climate Appraisal Services. (The West Coast and the New England coast fare best in CAS's computer models, the Gulf Coast the worst.) David Purcell, an ex-banker who founded CAS in 2006 with a trio of University of Arizona scientists, views Florida beachfront as an incredibly risky investment. "Twenty years from now," Purcell says, "if you're looking to sell, you may find there's nobody willing to step into your shoes

RPAC Auction Combines Fun and Fundraising - 6/17/2008

One of the most enjoyed ECAR events is back. Thursday, members will meet at the Village in Destin to network, eat, and raise money for the Realtor Political Action Committee (RPAC). The event will include a silent auction, a live auction, entertainment, free food, and a raffle for a cruise donated by McNeese Title. Auction items include condo stays, dinners, and unique art. All proceeds, including a contribution at the door, will go to RPAC. RPAC uses these contributions to fund local, state, and national candidates and issues. The silent auction begins at 4:00 p.m. and the event will end at 8:00 p.m. The Village is located on the site of the old Destin RV Resort off U.S. Highway 98, across from Bass Pro Shop behind the Waffle House.

Short sales come up short - 6/17/2008

SHORT SALES COME UP SHORT

Realtors across the country believe mortgage lenders make the housing downturn worse by taking months to make decisions on short sales and sticking to high internal target prices. As a result, more home buyers avoid short sale properties, forcing foreclosure sales that typically result in lenders accepting lower prices than they could have achieved in the short sale. "The only question banks should ask is can they make more in a short sale than in foreclosure," according to Lighthouse Point, Fla.-based Realtor Ron Rosen, who cites a "broken" system. "The answer is that in nine out of 10 cases, they will lose more money in a foreclosure." Some Realtors contend that lenders lack the appropriate systems and staff to handle short sale requests, while lenders insist the short sale process is complicated by the need for approvals from investors and mortgage insurers. Still, Realtors note that a more efficient short sale process would boost prices and reduce inventory.

Suburbans farming - 6/17/2008

It was bound to happen. With high food and gas prices, water rates going up and available land going for biofuel, some suburbanite was probably going to plant over their lawn and azaleas with, dare we say it, crops. An April 22 report in The Wall St. Journal, by Kelly Spors, talks about the trend of moving the backyard tradition of growing a few supplementary vegetables during local growing seasons, to the front yard - and turning it into a business. The technical name is SPIN (small plot intensive) farming, and loads of folks are doing it. LawnsToGardens and PathToFreedom are but a few examples of web-sites with additional information about this interesting trend.

HOUSING AID

The House on Thursday passed a massive homeowner rescue plan to provide cheaper, government-backed mortgages to half a million debt-ridden borrowers and bolster an economy hurt by the housing crisis. The Senate now must consider the bill and President Bush has threatened a veto.



My question would be why was this not done already and why would any veto this?

Despite the sluggish economy, investors this year are putting their money into funds that invest in real estate investment trusts (REITs), a turn-around of recent trends. A total of $1.23 billion flowed into domestic REIT funds in the first three months of the year, according to new research.

Getting Better in Florida - 6/17/2008

According to Realty Times, Florida real estate experts say the state's housing market is showing signs of recovery, despite falling residential prices and rising foreclosures and short sales. They note that inventory is expanding at slower rates, and home sales are on the rise in some markets. The Realtor Association of Greater Fort Myers, for instance, reports an 85-percent surge in pending single-family home sales in its area during the past 10 weeks. Meanwhile, pending sales jumped 65 percent in February from January in Fort Lauderdale, and 30 percent in March from the prior month in Palm Beach County.

St. Joe sees bottom of housing market - 6/17/2008

JACKSONVILLE, Fla. - May, 2008 - Florida's biggest landowner, the St. Joe Co., believes the housing market may have reached the bottom, pointing to stabilization in the residential inventory.

St. Joe Co. CEO Peter Rummell says buyers must be "retrained" to recognize the importance of making home purchases now. He notes, "We have trained people to expect that prices are going to be lower tomorrow than today if they just wait. So now people are going to have to learn that they've gotten to that point."

Though the company posted a $32 million profit for the first quarter, only $9.8 million can be attributed to its residential operations. Much of the firm's profits can be tied to the sale of "nonstrategic" land parcels in the Florida Panhandle, including 57,435 acres it recently sold to a group of buyers including sportsmen, investors and conservationists for $91 million.

Liberty Mutual way to go - 6/17/2008

Liberty Mutual Develops Green Building Insurance Policy



Insurance provider Liberty Mutual has introduced new commercial property coverage tailored specifically for LEED- or Green Globes-certified buildings.

The policy responds to the rising popularity of green buildings, Boston-based Liberty Mutual said in a statement. In the event of a covered loss to a green building, the policy would provide insurance for building recommissioning and re-certification fees, the installation of a "green" vegetative roof, debris recycling and the installation of green-certified products such as those under the Energy Star label.

In the event of a re-certification, the cost to increase the property sustainability rating by one level (for instance, LEED Silver to LEED Gold) would also be covered.

The policy also covers green retrofits to non-green properties. "Our endorsement encourages property owners to consider the environmental impact of their business and enables them to act responsibly regardless of whether or not they pursue green certification," stated Liberty Mutual President Tim Rose.

The Liberty Mutual policy is similar to one created by Fireman's Fund in 2006, the first sustainable building policy issued by a major insurance provider. Fireman's Fund broadened that policy last year with increased coverage for loss of earnings, soft costs like re-registration or re-certification, and rental value.

Liberty Mutual follows LEED guideline protocols at its 22-owned buildings and 9 million square feet of leased space. The company owns one LEED-certified building and has two buildings in the certification process.

RREEF, Advance Realty Endorse BOMA 7-Point Challenge



BOMA has landed two new participants for its 7-Point Challenge green building program.

Investment manager RREEF North America and New Jersey-based owner and developer Advance Realty Group both endorsed the voluntary program that seeks to cut energy consumption across property portfolios by 30 percent by 2012.

Launched last summer, the 7-Point Challenge is one of the most popular green building advocacy initiatives created the industry trade group. More than 30 local BOMA chapters and 25 industry firms have joined the program, including CB Richard Ellis, Cushman & Wakefield, USAA Real Estate Co., The Irvine Co., Hines, Transwestern and Shorenstein. "Market transformation is achievable when organizations ... step up to the challenge," said Brenna Walraven, BOMA International's Chairman and Chief Elected Officer and an executive managing director with USAA.

To decrease energy usage in buildings, the program taps EPA Energy Star benchmarking, education and training for building personnel, and energy audits to identify and implement low-cost energy efficiency strategies.

Mike Kent, managing director of leasing and property management for RREEF, called the program a "natural next step" for the Deutsche Bank subsidiary. "We are committed to further developing our sustainable business practices and to fostering an eco-friendly community that involves our tenants and investors," he said.

RREEF Real Estate has about $49 billion in assets under management worldwide.

Advance Realty, the Peter Cocoziello-led firm that owns One Gateway Center in Newark, NJ, boosted its sustainable real estate platform in March by hiring energy management firm GSH Group to implement energy conservation practices across its Mid-Atlantic property portfolio of roughly 4.5 million square feet.

Energy Star Expert to Hone Sustainability at GE Real Estate



GE Real Estate has tapped former EPA Energy Star executive Stuart Brodsky as regional sustainability leader for its North America Equity unit.

Brodsky's appointment comes as GE is ramping up green activities across its massive property portfolio of more than 385 million square feet. Its recent sustainable initiatives include broader commitments to LEED certification and energy benchmarking, leaning on customers and vendors to improve their environmental performance, and a partnership with Bill Clinton's Clinton Climate Initiative to cut energy consumption and emissions in cities.

Brodsky, a familiar name in commercial real estate circles, will help GE develop and execute a sustainable business strategy that is both environmentally friendly and profitable. "Stuart has designed several energy efficiency programs for leading industry groups. His appointment is another step forward in achieving our goal of embedding sustainability into our practices to benefit the environment and our business," said Christian Blechinger, managing director at GE Real Estate.

At the Environmental Protection Agency, Brodsky was national program manager for commercial property markets for the Energy Star program. He led the agency's outreach initiatives and partnerships to industry groups like the Building Owners and Managers Association (BOMA), the National Association of Real Estate Investment Trusts (NAREIT), the Real Estate Roundtable, and the Green Building Finance Consortium.

The dire headlines coming fast and furious in the financial and popular press suggest that the housing crisis is intensifying. Yet it is very likely that April 2008 will mark the bottom of the U.S. housing market. Yes, the housing market is bottoming right now.


How can this be? For starters, a bottom does not mean that prices are about to return to the heady days of 2005. That probably won't happen for another 15 years. It just means that the trend is no longer getting worse, which is the critical factor.


Most people forget that the current housing bust is nearly three years old. Home sales peaked in July 2005. New home sales are down a staggering 63% from peak levels of 1.4 million. Housing starts have fallen more than 50% and, adjusted for population growth, are back to the trough levels of 1982.


Furthermore, residential construction is close to 15-year lows at 3.8% of GDP; by the fourth quarter of this year, it will probably hit the lowest level ever. So what's going to stop the housing decline? Very simply, the same thing that caused the bust: affordability.


The boom made housing unaffordable for many American families, especially first-time home buyers. During the 1990s and early 2000s, it took 19% of average monthly income to service a conforming mortgage on the average home purchased. By 2005 and 2006, it was absorbing 25% of monthly income. For first time buyers, it went from 29% of income to 37%. That just proved to be too much.


Prices got so high that people who intended to actually live in the houses they purchased (as opposed to speculators) stopped buying. This caused the bubble to burst.


Since then, house prices have fallen 10%-15%, while incomes have kept growing (albeit more slowly recently) and mortgage rates have come down 70 basis points from their highs. As a result, it now takes 19% of monthly income for the average home buyer, and 31% of monthly income for the first-time home buyer, to purchase a house. In other words, homes on average are back to being as affordable as during the best of times in the 1990s. Numerous households that had been priced out of the market can now afford to get in.


The next question is: Even if home sales pick up, how can home prices stop falling with so many houses vacant and unsold? The flip but true answer: because they always do.


In the past five major housing market corrections (and there were some big ones, such as in the early 1980s when home sales also fell by 50%-60% and prices fell 12%-15% in real terms), every time home sales bottomed, the pace of house-price declines halved within one or two months.


The explanation is that by the time home sales stop declining, inventories of unsold homes have usually already started falling in absolute terms and begin to peak out in "months of supply" terms. That's the case right now: New home inventories peaked at 598,000 homes in July 2006, and stand at 482,000 homes as of the end of March. This inventory is equivalent to 11 months of supply, a 25-year high - but it is similar to 1974, 1982 and 1991 levels, which saw a subsequent slowing in home-price declines within the next six months.


Inventories are declining because construction activity has been falling for such a long time that home completions are now just about undershooting new home sales. In a few months, completions of new homes for sale could be undershooting new home sales by 50,000-100,000 annually.


Inventories will drop even faster to 400,000 - or seven months of supply - by the end of 2008. This shift in inventories will have a significant impact on prices, although house prices won't stop falling entirely until inventories reach five months of supply sometime in 2009. A five-month supply has historically signaled tightness in the housing market.


Many pundits claim that house prices need to fall another 30% to bring them back in line with where they've been historically. This is usually based on an analysis of house prices adjusted for inflation: Real house prices are 30% above their 40-year, inflation-adjusted average, so they must fall 30%. This simplistic analysis is appealing on the surface, but is flawed for a variety of reasons.


Most importantly, it neglects the fact that a great majority of Americans buy their houses with mortgages. And if one buys a house with a mortgage, the most important factor in deciding what to pay for the house is how much of one's income is required to be able to make the mortgage payments on the house. Today the rate on a 30-year, fixed-rate mortgage is 5.7%. Back in 1981, the rate hit 18.5%. Comparing today's house prices to the 1970s or 1980s, when mortgage rates were stratospheric, is misguided and misleading.


This is all good news for the broader economy. The housing bust has been subtracting a full percentage point from GDP for almost two years now, which is very large for a sector that represents less than 5% of economic activity.


When the rate of house-price declines halves, there will be a wholesale shift in markets' perceptions. All of a sudden, the expected value of the collateral (i.e. houses) for much of the lending that went on for the past decade will change. Right now, when valuing the collateral, market participants including banks are extrapolating the current pace of house price declines for another two to three years; this has a significant impact on the amount of delinquencies, foreclosures and credit losses that lenders are expected to face.


More home sales and smaller price declines means fewer homeowners will be underwater on their mortgages. They will thus have less incentive to walk away and opt for foreclosure.


A milder house-price decline scenario could lead to increases in the market value of a lot of the securitized mortgages that have been responsible for $300 billion of write-downs in the past year. Even if write-backs do not occur, stabilizing collateral values will have a huge impact on the markets' perception of risk related to housing, the financial system, and the economy.


We are of course experiencing a serious housing bust, with serious economic consequences that are still unfolding. The odds are that the reverberations will lead to subtrend growth for a couple of years. Nonetheless, housing led us into this credit crisis and this recession. It is likely to lead us out. And that process is underway, right now.

NAR Commercial Profile Report - 6/17/2008

According to the latest NAR Commercial Member Profile, commercial members experienced a 7 percent jump in median sales volume for 2006, reaching a median of $2.249 million in sales. Selling land was the single largest commercial specialty for respondents, accounting for 19 percent.



WASHINGTON - Reflecting a strong commercial real estate market last year, commercial members of the National Association of Realtors® (NAR) surveyed for the NAR Commercial Member Profile experienced a 7 percent jump in median sales volume for 2006, reaching a median of $2.249 million in sales. Respondents closed a median of eight transactions, the report noted.

Those members affiliated with one of NAR's affiliated commercial specialty groups achieved higher totals, led by members of the Society of Industrial and Office Realtors®, who had a median of 25 transactions in 2006. Experience also played a role in increasing sales volume; members who had worked in commercial real estate for 26 or more years reported a median sales volume of $5.057 million.

Selling land was the single largest commercial specialty for respondents, accounting for 19 percent of business activities among members. Other principal business activities for commercial practitioners included multifamily sales (11 percent), retail building sales (10 percent), and office building sales (8 percent).

Accounting for 11 percent of total business activity among commercial members, office leasing was the only leasing or management activity that reached double digits among respondents. Commercial members involved in leasing activity saw a 12 percent increase in leasing activity during 2006. Median lease transaction volume for members was $183,300. As with sales, the dollar value of lease transactions increases with business experience, reaching $187,000 for members with 16 to 25 years of commercial real estate experience.

A summary of the report's findings was presented last week during NAR's Midyear Legislative Meetings and Trade Expo in Washington, D.C.

Taking care of your estate planning and ungrateful recipients - 6/17/2008


The University of California, Santa Cruz recently landed one of the great prizes in college fundraising: a treasure trove of Grateful Dead memorabilia. The collection spans 30 years, from 1965 when the band was formed, to 1995, when Jerry Garcia, the band's lead guitarist, vocalist and spiritual leader, died.


The gift, as the Wall Street Journal noted, is expected by many to turn the Silicon Valley campus into "a mecca for scholars and ... `Deadhead' fans." And, of course, it should generate additional contributions.


American colleges and universities are prodigious fundraisers. Most of the attention focuses on cash gifts and bequests, which exceeded $29.7 billion last year. But money is not the only prize.


The Harvard University Art Museums and the Blanton Museum of Art at the University of Texas, Austin, for example, both have been designated to receive 50 works of art from the collection of New York philanthropists Dorothy and Herbert Vogel. The donations are part of a national gift program, "Fifty Works for Fifty States," in which 2,500 works from the Vogel collection will be distributed during 2008 and 2009, with 50 institutions (one in each state) each receiving 50 pieces of art.


The University of Michigan art museum also received a large donation of art this year, from the collection of retired UM professors Frances McSparran and her late husband, Ernst Pulgram.


While donors may consider such gifts - everything from land and art to first edition books, historical maps, artifacts and papers - straightforward and safe, and may even receive substantial tax benefits from donating appreciated assets, tangible gifts have special risks. One of the greatest risks some have learned is that the recipient institution and presumed steward of the gift will sell it.


Consider the case of Mattie Kelly. In 1992, Kelly bequeathed her 13-acre estate and $500,000 to Okaloosa-Walton Community College in (I kid you not) Niceville, Fla. The gift stipulated that a cultural and environmental institute and memorial garden be established on the property. Instead, the college sold the land to developers and pocketed both the proceeds and the $500,000.


In Lynchburg, Va., Randolph College last year did everything but hang a "Garage Sale" sign on its Maier Museum of Art. Many paintings in the museum's nationally acclaimed collection had been donated by faculty and alumna, or bought with funds given for that purpose by local residents. One painting - "Troubador" by Mexican master Rufino Tamayo - was recently auctioned off by Christie's New York for $7 million. More are likely to be sold.


Many other colleges - including Sewanee, University of the South, in Tennessee, St. Olaf College in Minnesota, Trinity International University in Illinois, and Tulane University in New Orleans - also have been involved in controversies over non-cash gifts.


In the end, philanthropists should be wary of giving away the family jewels. And when they do choose to donate personal or real property they need to protect themselves.


The best way to do that, for the benefit of donors and recipients alike, is to include clear language in all gift agreements spelling out the stewardship obligations of the recipient institution, circumstances under which the gift would have to be returned or repaid, and giving a third party legal standing to sue if the agreement is violated.


There is no reason to believe that UC Santa Cruz acted in anything less than total good faith. Yet, commitments made today can easily be abandoned tomorrow.


By coincidence, the Grateful Dead's first known record was the 1966 single "Stealin.'" To some of us that's what it is when a nonprofit institution, such as a college, accepts a valuable gift and then, without the donor's or a court's permission, sells it.

I can't comment on all of these cases but the one local mattie kelly case was a big deal with everyone around here as many of the older generation in our area have big hearts and watched this case carefully when looking at what to leave from there estates and how to go about it. It is a shame really.

Getting Your House Ready to Sell Story from Tara Roberts of the Crestview Bulletin - 3/10/2007

When selling a house, owners do not necessarily need to make expensive upgrades and renovations on their home to improve their chances at a quick sell. The simple task of cleaning the outside and inside is one of the best ways to perk up the appearance of a house. Maybe a little paint here, a few minor repairs there and it has a completely new look.

First Impressions

When a potential buyer is introduced to your house, the exterior is the first thing seen. Is the front door scuffed and in need of a facelift? Outer doors, walls and shutters need a good cleaning, and sometimes a fresh coat of paint. If the front door is in really bad shape, consider replacing it.

Use a pressure washer to clean away dirt, mildew and oil stains on walks, driveways and exterior walls. Also give porches, decks and fences a good scrubbing. Some hardware or home improvement stores offer rental equipment for the do-it-yourselfer, or hire a cleaning service. Check windows and screens for damage, and repair or replace these before showing the house. Cracked or broken sidewalks and driveways should also be repaired.

Sprucing Up

Take a good look at your landscaping. How does it compare to your neighbor or the rest of the neighborhood? Add a splash of color by planting flowers or small shrubs. Keep the lawn mowed and neatly trimmed. Rake up leaves and grass cuttings, and prune trees and hedges. These little touches do not have to be expensive, and can noticeably brighten the outside of your house.

Sometimes houses are shown in the evenings. Do outside lights work? Is the house number clearly visible? Remember to keep garage doors shut and trash cans out of sight. Small details can make a big difference.

Less is Better

Once inside the house, the key is less is better. As the owner, you are trying to sell a house; potential buyers are looking for a home. That means you have to de-personalize your house by getting rid of clutter so buyers can better visualize how they would give the house their own personality.

Remove personal photos, pack away that collection of state spoons, and take down all those sports trophies and school memorabilia. Not everyone is a fan of the same team. Put any valuables out of sight. Rent a storage unit and finally clean out the garage, attic and overflowing closets. Use this as an opportunity to begin packing or plan a yard sale to offset the cost of improvements.

Clear off kitchen counters and empty cabinets. Clean the outside and inside of ovens, refrigerators and dishwashers, especially if these appliances stay with the house. Keep the dishwasher, clothes dryer and washer, and trash cans empty. Do not hide dirty dishes or clothes in the washers.

Clean, Repair, Replace

Check doors and doorknobs, windows, lighting fixtures and electrical outlets, and faucets to make sure they are all in good shape and functional. Repair any damaged bathroom or floor tiles, or cracks in walls and ceiling. Replace any worn or stained carpet, and torn or peeling wallpaper.

Take the opportunity to do a complete floor to ceiling cleaning. Sweep out cobwebs from corners, get rid of dust bunnies under beds and other furniture, wash windows, walls and floors, and shampoo carpets. You could use the money earned from your de-cluttering yard sale to hire a professional cleaning service.

Remember not everyone likes cranberry or royal blue walls. Consider painting interiors walls a more neutral color. Replace elaborate window treatments with plain drapes or curtains.



The Little Things

Remember the little things like making beds, putting out matching towels in the bathrooms, setting the thermostat on a comfortable setting, and keeping lights on and blinds or drapes open.

Smokers, pet owners and parents with infants need to recognize that, while resulting odors may have become unnoticeable to you, they are not undetectable to potential buyers. Consider smoking outside while you are trying to sell your house. Clean litter boxes daily and keep dogs outside as much as possible. Throw away diapers in an outside container immediately. Use air freshener or light scented candles. Bake a batch of cookies or homemade bread on days of showing.

Enlist the help of a friend to inspect your house as a prospective buyer might. Encourage honest feedback on what improvements you could make to help the sale of your house. Most upgrades do not need to be costly and, in many cases, expensive renovations do not give a good return on your investment. Potential buyers should be able to see how great your house is and not try to imagine what it would be like with a little work.

Saving Money at Closing - 12/18/2006

Savings Tips
Fees for some standard items, such as appraisal, credit report and title insurance should be almost the same at every lender. The same goes for payments to local governments, such as documentation stamps and recording fees.

A bank or mortgage company may be willing to drop some of the fees if you opt out of a service. For instance, they may overnight documents back and forth for faster approval. If you are not in a hurry, you can ask that the documents be sent by regular mail and the overnight charges be dropped.

Watch out for "junk fees" or additional charges. Most mortgage programs include them, but you should be able to negotiate them down or eliminate them.

Other Ways to Save on Costs


Try to close your mortgage near the end of the month. Because all mortgage loans are due on the first of the month, you will have to pay interest from the day you close until the end of the month. You can avoid or greatly reduce prepaid interest due by closing the last day of the month or near that date, and save yourself hundreds of dollars.

As part of the sale contract, you can negotiate with the seller of the property to help pay for some of the closing costs, points or other fees.

Plan ahead with your mortgage lender. Don't wait until the day of closing to try to reduce costs.

Qualified Intermediary receives Certified Exchange Specialist TM Recognition - 12/3/2006

Destin, Florida: Old South 1031 Exchange Services, LLC, a nationwide 1031 Qualified Intermediary announces that Andrew Gustafson, a principal of the firm, is one of twelve business professionals in the state of Florida and less than two hundred nationally to earn the Certified Exchange Specialist (CES) designation, after meeting the examination and work-experience criteria established by the Federation of Exchange Accommodators (FEA). The FEA is a non-profit trade organization with a nationwide network of certified professionals accountants, attorneys, real estate brokers, and others to help investors handle the requirements of Section 1031 transactions.

Section 1031 Exchanges are complex transactions that permit investors to defer capital gains taxes on the sale of certain types of business, investment, or income property, provided specific criteria are met, including the replacement of the property with one or more properties of "like kind." Investment real estate is the most common type of property exchanged in this manner, though many other types of property can be bought and sold through a 1031 exchange. Examples include construction equipment, easements, livestock, oil and gas, minerals, timber, water rights, airplanes, boats and yachts, and motor vehicles, among others.

The FEA is encouraging taxpayers to consider using a Certified Exchange Specialist to act as a "qualified intermediary" for their 1031 for good reason. According to Andrew Gustafson, "Almost anyone can claim to be a Qualified Intermediary. The problem is that Section 1031 Exchanges are complicated and highly specific, so even a small mistake could completely wipe out the potential tax benefits. The FEA's certification program is intended to allow taxpayers to make informed decisions when selecting a Qualified Intermediary."

Fees on a Mortgage - 11/28/2006

Fees on a mortgage cover almost every cost associated with getting a loan. You've already encountered fees upfront for a credit report and a property appraisal.

But there are many more fees that you will be expected to pay at closing or settlement, which is generally 30 to 60 days after finalizing the sales contract. These closing costs are outlined in the "good faith estimate." The Real Estate Settlement Procedures Act requires every bank or mortgage company to give the buyer the estimate within three days of applying for the loan. It will list expenses related to inspections, taxes, title insurance and a host of other charges. You also should receive an information booklet, "Settlement Costs -- a HUD Guide."

Tip:The best approach is to get a copy of the good faith estimate before you make a commitment to any lender.

Typical Closing Costs
Here is a list of typical closing costs. In general, closing costs amount to 3 percent to 6 percent of the sale price. Note items with an asterisk (*) are explained below. For an estimated price range, see the separate Standard Closing Costs.


Title Insurance
This is a policy that insures against errors in the title search, essentially guaranteeing you and your lender's financial interest in the property. It checks for any defects, liens or encumbrances on the property that may affect the rights of ownership, possesion or use of the property. It is issued after a complete examination of the public records. It also insures against such things as forgery, fraud, missing heirs or divorce actions. Keep in mind that the required title insurance protects the lender. You may want to take out an owner's title insurance to protect yourself.

Escrow
At closing you may have to put aside money into special escrow accounts to cover other costs associated with buying a home, such as private mortgage insurance (PMI), property taxes and homeowner's insurance. This will ensure that taxes and insurance premiums on the property are paid on time. Federal law limits the amount of "cushion" to two months of escrow payments. Be sure to ask the lender what escrow payments will be required at closing. Some mortgage companies may waive escrow requirements if you pay more points or a higher interest rate.

Savings Tips
You may be able to lower the cost of title insurance if the home you're buying hasn't been owned for a long time by the seller. The insurer may be willing to give you a re-issue rate, hence lower a premium, if there have been no claims against the title since the previous title search was done. If both you and the seller are getting title insurance, you can save by using the same title insurance firm. The cost will be lower since the insuror researches the property only once for both of you.

It is important to review the estimate of closing costs and to ask questions about fees that seem unfamiliar. Lenders differ and can get creative when it comes to other types of charges.

At this point, having secured the mortgage loan, you already have paid for the loan application fee, the property appraisal and some of the down payment. At the closing, you will need to pay the balance of your down payment. There are other costs that still must be paid in order to close the sale, unless you already have arranged and paid for them. The Difference Between Real Estate Agent and Realtor - 11/10/2006

Though the two terms are often used interchangably, real estate agents and REALTORS have different connotations. While both types of real estate professionals help clients buy and sell property in a similar fashion, REALTORS are members of the National Association of REALTORS. Retaining membership to this prestigious organization requires a strict adherence to seventeen tenets of ethical behavior in real estate transactions.

While evaluating the ethical behavior if each individual real estate professional would prove impossible and the morality of each REALTOR is not guaranteed, it is fact that unaffiliated real estate agents are not required to conform to these policies.

The Seventeen Commandments of REALTORS

1. Treat your clients, buyers, sellers, landlords, or tenants, fairly and honestly while protecting and promoting their interests.

2. Do not misrepresent, exaggerate, or lie about any property. However, you are not responsible for latent defects or providing advice unrelated to real estate.

3. Cooperate with other brokers, except when cooperation is not in your clients best interest.

4. If you have any personal interest in the property (for yourself, friends, family, or co-workers), you must tell the property owner. If selling your own home, you must reveal this information to the buyer.

5. Do not represent a property of which you have marked interest without disclosing this information to all affected parties.

6. Do not take any commissions or additional fees for favors or recommendations without notifying the client when these costs are first mentioned.

7. Do not accept compensation from more than one party per transaction without prior approval from all parties involved.

8. Keep your personal assets in a separate account from your professional funds.

9. Make sure all agreements and contracts are written explicitly in laymens terms that all clients will understand. After signing, give each party a copy of the contract.

10. Do not discriminate based on race, color, religion, gender, handicap, familial status, or national origin.

11. Conform to quality standards of the specific type real estate transaction. Do not undertake a job if it is outside of your field without the assistance of a professional competent in said field.

12. Represent yourself honestly to the public, clearly stating your professional status.

13. Do not pretend you are a lawyer.

14. Cooperate, be honest, and present all facts if you are charged with unethical practice. Do not disrupt the proceedings.

15. Do not engage in slanderous activity against competitors.

16. Do not interfere with other REALTORS exclusive relationships with their clients.

17. In the event of a dispute, go to the REALTOR board for arbitration rather than going to a regular legal court.

Changes in VA Funding Fees - 11/7/2006

Effective October 2006, changes in VA funding fees went into effect. The new changes are impacting both active duty as well as retired service members.

First-time use remains 2.15%, but subsequent use rose from 3.30% to 3.35%. 5-10% down gets you 1.50% while a down payment of 10% or more gets you a 1.25% funding fee.

For the Reserves and the National Guard, the VA funding fee for first-time home buyers is 2.40%. Subsequent use is 3.35%; a 5-10% down payment gets you a 1.75% funding fee and 10% or more down gets you 1.50%.

Total loan amount is equal to the sales price plus an additional amount of sales price times the VA funding fee.

Example: with a sales price of $250,000, for an active duty first-time usage:

$250,000 + ($250,000 x 2.15%)
$250,000 + $5,375
$255,375.

Free Credit Reports - 11/1/2006

I have tried it and it is truly free: no charge!

Have you ever been denied credit for a purchase even though you thought your credit was great? Have you ever wondered if you were a victim of identity theft? The answer could be in your credit report.

Until now you could not access this information without a fee. However, with the passage of the Fair and Accurate Credit Transaction Act, consumers can now get a free credit report annually from each of the three credit reporting bureaus that supply businesses with information on customers -- Equifax, Experian and TransUnion.
